SB 684 and SB 1123: up to ten units on a ministerial map
The Starter Home Revitalization Act, SB 684 as extended by SB 1123, lets an owner subdivide a lot into ten or fewer parcels and build ten or fewer units, with the map and the housing considered ministerially (Gov. Code 66499.41 and 65852.28).
Where it applies
- A lot zoned for multifamily of less than 5 acres, or a vacant single-family-zoned lot under 1.5 acres substantially surrounded by qualified urban uses.
- Ten or fewer parcels and ten or fewer units.
- In Los Angeles, the City's memo sets minimum parcels of 600 SF on multifamily lots and 1,200 SF on single-family lots.
- Housing occupied by tenants in the prior five years is excluded.
How approval works
- The parcel map or tentative tract map is considered ministerially, with no discretionary review or hearing; it is deemed approved if the City does not act within 60 days of a complete application (Gov. Code 66499.41(c)).
- The housing on the lots is considered ministerially within 60 days of a complete application (Gov. Code 65852.28(c)).
- In Los Angeles, applications are filed on CP13-1801 for up to four lots or CP-6110 for five to ten; hearings apply only in the Coastal Zone.
- Building permits may start after the tentative or parcel map is approved, under a covenant that no certificate of occupancy issues before the final map records.
The statute's current text (SB 1090, effective 30 September 2026) is replaced by further versions on 1 January 2027.
