SB 79 transit-oriented development in Los Angeles
SB 79 lets housing developments of five or more units reach set densities and heights near qualifying transit stops (Gov. Code 65912.155 to 65912.162). In the City of Los Angeles, every parcel is temporarily exempt under Ordinance 188,968, effective 30 June 2026.
What the state law allows
SB 79 applies to a housing development of five or more units, at 30 or more units per acre, on a residential, mixed-use or commercial site within half a mile or a quarter mile of a transit-oriented development stop (Gov. Code 65912.157(a)). It creates no separate ministerial process: a project may elect the ministerial approval of SB 35 (Gov. Code 65913.4), or follow the City's own review under the Housing Accountability Act.
Where it applies, the state sets minimums the City may not lower. Within a quarter mile of a Tier 1 stop (heavy rail or very high frequency commuter rail), at least 120 units per acre, 75 ft and a residential floor area ratio of 3.5; between a quarter and half a mile, 100 units per acre, 65 ft and 3.0. Tier 2 stops (light rail, high frequency commuter rail and bus with a dedicated lane) are set lower, and a site adjacent to a stop adds 40 units per acre, 20 ft and 1.0 of floor area ratio.
Status in Los Angeles
Ordinance 188,968, the City's phased implementation ordinance, temporarily exempts all parcels under Gov. Code 65912.161(b) (Sec. 4), effective 30 June 2026. The exemption lasts until one year after the City adopts the revision of its seventh-cycle Housing Element. Some parcels are exempted permanently (Sec. 1). The Director of Planning issues the eligibility maps, shown in ZIMAS (Secs. 3 and 6).
The pathways in use meanwhile
Near transit, a Los Angeles project reads the Mixed Income Incentive Program (LAMC 12.22 A.38), the State Density Bonus (A.37), AHIP and ED 1 for 100 percent affordable buildings (A.39 and A.40), and the state's AB 2011 and SB 35 pathways where they apply.
